By creating an account or using Globetrotter ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a binding agreement between you and Florian Pascal Abel, Barcelona, Spain ("we", "us", "our").
You must be at least 16 years old to use Globetrotter. By creating an account, you confirm that you meet this age requirement. We reserve the right to terminate accounts that we reasonably believe belong to users under 16.
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
Ownership: You retain ownership of all content you create or upload through Globetrotter, including photos, videos, trip reports, reviews, tips, ratings, and collections ("User Content").
License: By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, display, reproduce, distribute, adapt, and modify your User Content for the purpose of operating, improving, and promoting the Globetrotter service. This license continues even if you delete the specific content or your account.
Content after account deletion: When you delete your account, your personal data (name, email, profile) is erased in accordance with our Privacy Policy. However, User Content you contributed (such as photos, reviews, tips, and trip reports) may remain on the platform in anonymized form — meaning it will no longer be attributed to you or linked to any identifiable account. This ensures that community contributions continue to benefit all users.
Responsibility: You are solely responsible for your User Content. You represent and warrant that you have the rights to post it and that it does not violate any third party's rights or applicable law.
All content provided by Globetrotter (curated place descriptions, event information, cultural guides, design, branding, and software) is owned by us or our licensors and is protected by intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from our content without written permission.

You are solely responsible for the content you submit. We do not pre-screen User Content but reserve the right to remove, edit, or restrict access to any content that violates these Terms, without prior notice. We are not liable for any User Content posted by other users.
In compliance with the EU Digital Services Act (DSA), the App provides a mechanism to report or flag content that you believe violates these Terms or applicable law.
You may delete your account at any time from within the App (Settings > Delete Account). Account data will be permanently purged within 30 days of deletion.
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will notify you of the reason for termination where feasible.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We make reasonable efforts to ensure the accuracy of cultural event dates, place descriptions, and travel information, but we do not guarantee their accuracy, completeness, or timeliness. Travel information changes frequently. Always verify critical details (dates, visa requirements, safety conditions) through official sources before traveling.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the App.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
The App integrates with third-party services (Auth0 for authentication, Mapbox for maps, AWS for hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
We may update these Terms from time to time. Material changes will be communicated through the App or via email at least 14 days before they take effect. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms or your use of the App shall be resolved in the courts of Barcelona, Spain, without prejudice to any mandatory consumer protection provisions of your country of residence.
